Mumbai: In a significant ruling, the Dindoshi Sessions Court has granted bail to Sagar Arvind Kotak, a bicycle trader accused of molesting a minor girl under the POCSO Act at the Malvani police station in Mumbai. The court’s decision came after the defence argued that the victim had claimed to be 19 years old and that the relationship between the two involved mutual consent.

The case revolves around a complaint filed by the victim’s family. According to the FIR (number 83/2025), the accused allegedly lured the girl, promising her a bicycle, and later attempted to molest her while they were travelling in an auto-rickshaw. The incident reportedly took place on January 16, 2025, when the girl left home claiming she was going to a friend’s house. Upon returning, she appeared withdrawn and anxious, raising suspicions among her family, who later discovered incriminating messages and pictures on her phone.

The details reveal that in December, the victim had visited Sadguru Cycle Mart in Malad with her mother to buy a bike as a birthday gift for her younger sister. Although they were unable to make a purchase due to high prices, the shopkeeper gave the girl his business card, inviting her to contact him later. The accused allegedly arranged to meet her again, further deepening the relationship.

In court, Advocate Vijay Upadhyay represented the accused and presented a chat record between the victim and Kotak, seeking to prove the consensual nature of their contact. Advocate Nidhi, representing the complainant, emphasized the gravity of the accusations, while Advocate Mrs. Malankar argued on behalf of the state.

Granting bail, the court imposed several conditions: Kotak must appear at the police station every Wednesday from 4 PM to 5 PM, refrain from destroying evidence, avoid contacting the victim, and not leave the country without court permission. The bail was set at a personal bond of ₹25,000.

This case highlights the complexities involved in allegations of molestation, especially regarding the definitions of consent and minor protection laws in India. The court's ruling has sparked discussions about protective measures for minors and the legal parameters of consent in such sensitive cases.
